Terms & Conditions - Have a Chai Tea

Have a Chai Tea is a link-in-bio and creator monetisation platform that enables Indian creators to receive voluntary financial support through UPI and to manage their social links, product links, and digital product sales from a single shareable profile page.

The Platform does not produce or moderate creator content. Tips made through the Platform are voluntary contributions from supporters to creators and are not purchases of goods or services unless a creator has explicitly listed a digital product for sale.

To create a creator account, you must:

• Be at least 18 years of age
• Be a resident of India with a valid Indian bank account and PAN card
• Complete KYC verification through Cashfree Payments
• Provide accurate and truthful information during signup and onboarding

Supporters making payments do not need to create an account but must have a valid UPI-enabled payment method.

• Usernames are unique and issued on a first-come, first-served basis.
• Usernames must be lowercase, alphanumeric, may include hyphens, and may not exceed 30 characters.
• We reserve the right to reclaim usernames that are inactive for more than 12 months, impersonate real individuals or brands, or otherwise violate these Terms.
• You are responsible for all activity that occurs under your account.

By activating your creator account, you agree to the following fee structure:

The 1.6% rate reflects our locked promotional rate with Cashfree for year one of operation. The standard rate of 1.95% applies after the promotional period ends.

All fees are deducted automatically before payout. You will never be invoiced or asked to pay manually. You can see a precise breakdown of all deductions before confirming any withdrawal in your dashboard.

• Payouts are processed every Sunday for accumulated balances of ₹ 100 or more.
• Balances below ₹ 100 roll over to the following week with no penalty.
• Payouts are made via direct bank transfer through Cashfree Payouts to your verified bank account.
• The Platform is not liable for delays caused by bank holidays, incorrect bank details provided by the creator, or technical failures on the part of Cashfree.
• Creator earnings are held in Cashfree's RBI-mandated nodal account until disbursement and do not pass through the Platform's own bank account.

Creators must complete KYC verification through Cashfree before any payout can be processed. This includes PAN card verification and bank account verification.

Failure to complete KYC or providing inaccurate details will result in held payouts until the issue is resolved. The Platform is not responsible for funds held due to KYC non-completion.

You may not use this Platform to:

• Receive payments for illegal goods or services under Indian law
• Impersonate another creator, public figure, or brand
• Engage in fraud, money laundering, or activity that violates RBI guidelines
• Circumvent the Platform's fee structure
• Use automated tools to generate artificial transactions or inflate earnings

Violation of any of the above may result in immediate account suspension, reversal of pending payouts, and reporting to relevant authorities where legally required.

Creators who sell digital products such as downloadable files, PDFs, presets, or templates directly through the Platform are solely responsible for the quality, accuracy, and legality of those products.

The Platform acts as a distribution mechanism only and does not warrant or endorse any creator's digital products.

The Platform is provided on an "as is" basis. We make no guarantees regarding uptime, payment processing speed, or uninterrupted service.

To the maximum extent permitted by Indian law, our total liability for any claim arising from use of the Platform is limited to the platform fees collected from the relevant creator in the 30 days preceding the claim.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kerala, India.

We may update these Terms from time to time. Material changes will be communicated via email to registered creators.

Continued use of the Platform after the effective date of any change constitutes acceptance of the updated Terms.
